## 4. Our Legal Basis for Processing Your Information

Under the UK GDPR, we must have a lawful basis for collecting and processing your personal information.

Depending on the activity, we may rely on:

**Consent – Article 6(1)(a)**

Where you have freely agreed to a particular use of your personal information, including specified marketing activities or processing associated with an insurance enquiry.

**Legitimate Interests – Article 6(1)(f)**

Where processing is necessary for legitimate business purposes, such as responding to certain enquiries, maintaining business records, preventing fraud and improving our services, provided that our interests are not overridden by your rights and freedoms.

We may also rely on legitimate interests for direct marketing where permitted by applicable law, subject to the relevant balancing assessment and PECR requirements.

**Legal Obligation – Article 6(1)(c)**

Where processing is necessary to comply with a legal or regulatory obligation.

**Contractual Necessity – Article 6(1)(b)**

Where processing is necessary to provide a service under a contract with you or take steps at your request before entering into a contract, where applicable.

Where we process health information, we also require a separate condition under Article 9 UK GDPR, as described below.

## 5. Health and Medical Information – Explicit Consent

To help establish whether a customer may be suitable for a life insurance quotation or review, we may ask a limited preliminary question regarding serious medical conditions.

We only seek to establish whether you have any serious medical conditions that could prevent you from obtaining a life insurance quotation.

We do not request a full medical history or conduct detailed medical assessments.

**Consent to Processing Medical Information**

Before collecting health or medical information, we will ask for your explicit consent.

Where you provide that consent, you authorise DDS Marketing Limited, trading as Jack and Gill, to collect, process and share the relevant health or medical information you voluntarily provide with one selected life insurance partner or broker.

The purpose of this processing is to facilitate your requested life insurance quotation or policy review.

We rely on Article 9(2)(a) UK GDPR, which permits the processing of special-category personal data where the individual has provided explicit consent.

Agreeing to receive a quotation or review does not automatically constitute explicit consent to processing health information. We will request this consent separately before asking medical screening questions.

We will only collect and share information that is relevant and necessary for the stated purpose.

More detailed medical questions, insurance underwriting and eligibility assessments will be handled by the receiving insurance broker or insurer.

You may withdraw your consent at any time by emailing **Hello@jackandgill.co.uk**.

Withdrawal of consent will not affect processing already carried out lawfully before withdrawal.

## 6. Who Do We Share Your Information With?

Jack and Gill works with selected life insurance brokers and intermediaries to provide customers with access to competitive life insurance quotations and policy reviews.

### Our Exclusive One-Partner Guarantee

**We only share your personal information with one selected insurance partner or broker per enquiry, on an exclusive basis.**

We do not sell or distribute the same enquiry to multiple competing insurance brokers.

This means that, in relation to an enquiry made through Jack and Gill, your details will only be supplied to one selected partner, so you will not receive multiple calls from different insurance brokers as a result of us distributing your enquiry.

That selected partner may contact you to discuss your insurance requirements, review existing cover and provide an appropriate quotation.

### Our Insurance Partners

Depending on availability, suitability and the nature of your enquiry, your personal information may be shared with one of the following selected partners:

1. Tailored Life
2. Simply Covered
3. Assura Protect

### What Information Is Shared?

Depending on your enquiry, we may share:

– Your name and contact details.

Where they act as data processors, we require appropriate contractual safeguards to protect your information.

We may also disclose information where required by law, court order or an appropriate public authority.

These operational disclosures do not mean that your insurance enquiry is distributed to multiple brokers.

## 8. Marketing Communications and Telephone Contact

We may contact you by telephone, email or other permitted communication methods regarding:

– A life insurance enquiry you have submitted.
– A quotation or policy review you have requested.
– An introduction to a selected insurance partner.
– Relevant follow-up communications.
– Other marketing communications where permitted by law.

Any direct marketing will be carried out in accordance with UK GDPR and PECR.

Where consent is required for a particular marketing activity, we will obtain it before carrying out that activity.

Where we rely on legitimate interests for permitted live telephone marketing, we will respect applicable Telephone Preference Service requirements and any previous objections to contact.

You have the right to object to direct marketing at any time.

**To opt out of further marketing communications from Jack and Gill, email Hello@jackandgill.co.uk.**

We will record your request and take reasonable steps to ensure that you are not contacted again for the relevant marketing purposes.

If your information has already been provided to an independent insurance broker, you may also need to contact that broker directly regarding communications or processing carried out by them. Where appropriate, we will communicate relevant withdrawal or opt-out requests to that partner.

## 9. How Long Do We Keep Your Information?

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including enquiry management, record keeping, compliance, complaints and legal obligations.

Our standard retention period for enquiry information is up to **two years**, unless a longer period is necessary and legally justified.

Different retention periods may apply to records that must be preserved for legal, accounting, consent-evidence or dispute-resolution purposes.

When personal information is no longer required, we will securely delete or anonymise it, subject to any applicable legal obligations.

We may retain limited suppression records to ensure that customers who have opted out of marketing are not contacted again.

## 10. How Do We Protect Your Information?

We take appropriate technical and organisational measures to protect the personal information we process.

These measures may include:

– Restricted access to customer information.
– Secure systems and account authentication.
– Appropriate staff training and confidentiality requirements.
– Secure data transmission and storage.
– Access controls and system monitoring.
– Contractual safeguards with relevant service providers.
– Procedures for identifying and responding to data security incidents.

Although we take reasonable steps to protect your information, no method of electronic transmission or storage can be guaranteed to be completely secure.

## 12. Opting Out of Communications

We respect your right to decide whether you wish to receive further communications from us.

If you do not wish to receive further marketing contact from Jack and Gill, you can opt out at any time.

**Email: Hello@jackandgill.co.uk**

Please state that you wish to opt out of further marketing communications.

We will update our records and take appropriate steps to prevent further marketing contact.

Opting out of marketing does not necessarily require us to delete information that we must retain for legitimate legal or compliance purposes.

If you wish to request deletion of your information, please state this separately in your email.

These may include applicable UK adequacy regulations or approved contractual safeguards.

You may contact us for further information about any applicable international transfer safeguards.

## 16. Automated Processing and Profiling

We may use technology to organise enquiries, manage customer records and assist with allocating enquiries to an appropriate insurance partner.

We do not make solely automated decisions that produce legal or similarly significant effects on customers as part of our introduction service.

Final insurance eligibility, underwriting and policy acceptance decisions are made by the relevant insurance broker or insurer.

## 17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our business practices, insurance partners, technology or applicable legal requirements.

The latest version will be published on www.jackandgill.co.uk with an updated revision date.
